New HOA Laws Every Homeowner Should Know

Every year, Florida’s lawmakers make small tweaks to the rules that guide HOAs like ours. But this time? The changes were big, wide-ranging, and deserve your attention.

2023: Flags, Privacy & New Freedoms
HB 437 (Florida Statutes 720.304 & 720.3045) — flsenate.gov/Session/Bill/2023/437
Last year, Florida made sure homeowners like us have more freedom to express ourselves and use our property.
Flags: The law says our HOA cannot restrict certain types and sizes of flags you display on your property. There’s a long, specific list — worth reading if you want to put one up. Statute here: flsenate.gov/Laws/Statutes/2023/720.304
Privacy around back & sides:
Your HOA can’t restrict items you store or display on your lot if they aren’t visible from the street or a neighbor’s yard. Want to stash a kayak or a garden statue behind your fence? That’s your business.
2023: Meetings, Conflicts & More Clarity

Our board now has more detailed rules on how to operate:
- Meeting notices must list each agenda item clearly. No surprises at board meetings! You’ll know exactly what’s being discussed ahead of time.
- Mail is the default contact method. Unless you specifically choose to get info by email, River Wilderness will keep using your mailing address.
- No mixing member deposits with other HOA funds. Our treasurer keeps your money separate and safe.
- Tighter conflict of interest rules for board members. Some situations now automatically require directors to step down.
- More detailed fining process.

2024: The Great Document Share
HB 59 (Florida Statutes 720.303) — flsenate.gov/Session/Bill/2024/59
As of October 1, 2024, River Wilderness must ensure:
- Every homeowner gets a copy of our governing documents (by mail or digitally). New members get the docs right when they join. If we amend the rules, everyone gets an updated copy.

2024: Hurricane Protection Rules
HB 293 (Florida Statutes 720.3035) — flsenate.gov/Session/Bill/2024/293
Given Florida’s weather, it’s no surprise lawmakers added this:
- River Wilderness must adopt official specs for hurricane protection. This ensures shutters, impact windows, or other measures comply with local building codes. Statute definitions: flsenate.gov/Laws/Statutes/2024/720.3035
2024: Websites, Training, Debit Cards & Fines
HB 1203 (Various Florida Statutes in Chapter 720) — flsenate.gov/Session/Bill/2024/1203
This sweeping bill brought major changes:
HOA websites:
- By January 1, 2025, HOAs with 100+ parcels (like us) must have a website with specific records & notices accessible to homeowners. Luckily RWHOA.com already helps here — we’re enhancing it to meet all the new standards.
No HOA debit cards allowed anymore.
- All association expenses must be paid in safer, trackable ways.
Accountable Accounting:
- If you request a detailed breakdown of what you owe, the HOA must provide it in 15 business days. If we fail — and your fines are over 30 days old without prior notice — your fines get waived.
New board member education:
- Within 90 days of election or appointment, directors must complete state-approved training.
Ongoing education:- 4 hours/year for HOAs under 2,500 parcels.
- 8 hours/year for larger ones.
New rules on fines & hearings:
Hope we can all avoid this one!
- You get 14 days written notice of a hearing.
- The hearing must happen in 90 days, with written results within 7 days.
- Attorney fees only start after the fine’s due date passes.
New prohibitions:
- No fines for parking your pickup, personal work truck (not commercial), or first responder vehicle in your driveway or on HOA roads.
- Watch your trash cans (less than 24 hours before or after pickup) and holiday lights (must come down or you get written notice plus a week).
